AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, day care centers are not required to provide a list of employees to parents and guardians.  This information could help identify members of the community who could present a danger to children and help parents be informed of persons who will be around their children.

 

As proposed, S.B. 565 requires the posting of all current employees at a day care center or home under rules adopted by the executive commissioner of the Health and Human Services Commission. 

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the executive commissioner of the Health and Human Services Commission in SECTION 1 (Section 42.0551, Health and Safety Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter C, Chapter 42, Human Resources Code, by adding Section 42.0551, as follows:

 

Sec. 42.0551.  POSTING OF EMPLOYEE LIST.  (a) Requires each day-care center, group day-care home, and family home to post a list of all current employees at the center or home in accordance with rules adopted by the executive commissioner of the Health and Human Services Commission (executive commissioner).

 

(b)  Requires the executive commissioner to adopt rules regarding the size, wording, and placement of the list required under this section.

 

SECTION 2.  Effective date: September 1, 2005.
