AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

C.S.S.B. 588 requires the notice for Texas Commission on Environmental Quality permits for certain projects, in counties of 3.2 million or more, to be published in a newspaper that offers home delivery to residents in the area of the proposed project. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 5.552, Water Code, by adding Subsection (g), to require an applicant for a permit for a facility (involving certain types of waste disposal or extracting minerals) located or proposed to be located in a county with a population of 3.2 million or more to publish notice at least once within a certain timeframe.  Requires the notice to be published in the newspaper of largest circulation in that county that offers at least weekly home delivery to residences in the vicinity of the facility or proposed facility, or requires the notice to be published, if the facility to which the application relates is located or proposed to be located in a municipality, in a newspaper of general circulation in the municipality that also offers home delivery at least weekly to residences in the vicinity of the facility or proposed facility.

 

SECTION 2. Makes application of this Act prospective to applications for permits that are determined to be administratively complete on or after September 1, 2005.

 

SECTION 3.  Effective date: September 1, 2005.
