AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The 78th Legislature, Regular Session, 2003, granted authority and set out guidelines for navigation districts and port authorities to select contractors for construction, maintenance, and repair projects using competitive sealed proposals.  While this legislation has worked well for the most part, some port authorities have found that the 45-day evaluation period currently in statute is not long enough to thoroughly evaluate each proposal.

 

As proposed, S.B. 620 extends the evaluation period to 120 days so authorities can more thoroughly evaluate each proposal before making a final decision.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 60.463(e), Water Code, to require a navigation district, not later than the 120th, rather than 45th, day after the date of opening construction proposals, to evaluate and rank each proposal submitted.

 

SECTION 2.  Makes application of this Act prospective. 

 

SECTION 3.  Effective date: upon passage or September 1, 2005.
