AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

There has been confusion at the Texas Department of Insurance as to whether the Texas Amusement Ride Safety and Insurance Act applies to challenge courses.  Challenge courses are not rides, but teaching facilities that employ trained instructors and a curriculum.  As proposed, S.B. 636 clarifies that the law does not apply to challenge courses. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 2151.002(1), Occupations Code, to redefine "amusement ride."

 

SECTION 2.  Effective date:  upon passage or September 1, 2005.
