AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Current law specifies that the commissioner's court shall pay the Randall County Juvenile Board members not less than $600, and not more than $1,200 of annual compensation for the added duties imposed on the members.  The current cap on the upper limit for salaries to board members is lower than what the county wishes to pay those board members.    

 

As proposed, S.B. 672 removes the $1,200 cap on the salary of Randall County Juvenile Board members.  Additionally, this legislation applies several sections of the code from which the Randall County Juvenile Board was previously exempt.  The board has already been performing the functions mentioned in those sections, but was not statutorily required to perform them.  Applying those sections of the code to the board is an attempt to increase protection from liability for the board members while carrying out their duties.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Sections 152.1971(b) and (c), Human Resources Code, as follows:

 

            (b) Requires the commissioners court to pay the juvenile board members additional annual compensation set by the commissioners court at not less than $600, rather than not less than $600 nor more than $1,200, for the added duties imposed on the members. 

 

            (c) Provides that Sections 152.004 (General Expenses) and 152.0005 (Expenses of Board Members and Juvenile Court) do not apply to the juvenile board of Randall County.  Deletes text providing that the following sections of the Human Resources Code do not apply: Sections 152.0002 (Board Meetings), 152.0003 (Compensation), 152.0006 (Fiscal Officer), 152.0007 (Duties), and 152.0008 (Personnel).    

 

SECTION 2.  Effective date: September 1, 2005.
