BACKGROUND AND PURPOSE

 

Current law allows a municipality with a population of more than 10,000 to deduct municipal employee association dues from the paychecks of those employees who request such deductions.

 

C.S.S.B. 716 requires a municipality to make deductions at the request of a peace officer employed by the municipality only if the municipality already permits deductions for purposes other than those required by law or deductions for charities, employee benefits, and taxes.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

C.S.S.B. 716 amends subsection (a-2) to Section 141.008, Local Government Code, to require a municipality to make a payroll deduction for the payment of police officer association dues if the municipality already permits deductions for purposes other than charity, health insurance, taxes, or those required by law and if the police officer requests the reduction in writing.  The bill does not apply to those municipalities that have adopted meet and confer or collective bargaining.

 

In addition, C.S.S.B. 716 repeals Section 143.357, Local Government Code.

 

EFFECTIVE DATE

 

This Act takes effect September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute adds that this bill does not apply to those cities who have adopted meet and confer or collective bargaining and adds a repeal of Section 143.357, Local Government Code.
