AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Current law allows a municipality with a population of more than 10,000 to deduct employee association dues from the paychecks of those employees who request such deductions. As proposed, S.B. 716 requires a municipality to make deductions at the request of a peace officer employed by the municipality only if the municipality already permits deductions for purposes other than those required by law or deductions for charities, employee benefits, and taxes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 141.008, Local Government Code, by adding Subsection (a-2) to require the governing body of a municipality to make the payroll deduction described by Subsection (a) if requested in writing by employees who are peace officers as defined by Article 2.12 (Who Are Peace Officers), Code of Criminal Procedure, and if the municipality permits deductions for purposes other than charity, health insurance, taxes, or other purposes for which the municipality is required by law to permit a deduction.

 

SECTION 2.  Effective date:  September 1, 2005
