AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Manufacturers of all-terrain vehicle (ATVs) are concerned because some of the new models of ATV's being manufactured do not meet the current definition of an ATV.  They are concerned that some ATV users can be ticketed by law enforcement while driving on public property if their specific ATV model does not fit the current definition.      

 

As proposed, S.B. 717 changes the definition of an all-terrain vehicle to reflect the different ATV models that are now available to the public. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 502.001(1), Transportation Code, to redefine "all-terrain vehicle."

 

SECTION 2.  Effective date: September 1, 2005.
