AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Current Texas law states that domestic wells located on more than ten acres of land are exempt from the Cow Creek Groundwater Conservation District's (district) annual fees.
S.B. 839 authorizes the district to collect a fee on all wells used for domestic purposes.
RULEMAKING AUTHORITY
Rulemaking authority previously granted to the Cow Creek Groundwater Conservation District is modified in SECTION 1 (Section 3.0111, Chapter 966, Acts of the 77th Legislature, Regular Session, 2001) and SECTION 2 (Section 11, Chapter 1349, Acts of the 77th Legislature, Regular Session, 2001) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 3.0111(d), Chapter 966, Acts of the 77th Legislature, Regular Session, 2001, as follows:
(d) Authorizes reasonable fees, as determined by the Cow Creek Groundwater Conservation District, to be imposed on an annual basis on each nonexempt well and on each well exempt from permitting under Section 36.117(b)(1), Water Code.
SECTION 2. Amends Section 11(d), Chapter 1349, Acts of the 77th Legislature, Regular Session, 2001, to make a conforming change.
SECTION 3. Effective date: upon passage or September 1, 2005.
