AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Current Texas law states that domestic wells located on more than ten acres of land are exempt from the Cow Creek Groundwater Conservation District's (district) annual fees. 

 

As proposed, S.B. 839  authorizes the district to collect a fee on all wells used for domestic purposes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 3.0111, Chapter 966, Acts of the 77th Legislature, Regular Session, 2001, by adding Subsection (b-1), as follows:

 

(b-1) Provides that Section 36.117(b)(1), (regarding the authority to regulate the spacing or production of water wells), Water Code, does not apply to the Cow Creek Groundwater Conservation District.

 

SECTION 2.  Amends Section 11, Chapter 1349, Acts of the 77th Legislature, Regular Session, 2001, by adding Subsection (b-1), to make a conforming change.

 

SECTION 3.  Effective date: upon passage or September 1, 2005.
