AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
The late Marshall Formby served the Texas Highway Commission as a member from 1953 to 1956 and as chair from 1957 through 1959.
He served as state senator from District 30, which encompassed much of Lubbock and portions of the Panhandle, while concurrently serving with the Corps of Engineers during World War II. Mr. Formby was also a newspaper publisher, farmer, and radio station owner.
S.B. 921 designates the portion of Interstate Highway 27 between Lubbock and Amarillo as the Marshall Formby Memorial Highway.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter B, Chapter 225, Transportation Code, by adding Section 225.059, as follows:
Sec. 225.059. MARSHALL FORMBY MEMORIAL HIGHWAY. (a) Provides that Interstate Highway 27 between its intersection with United States Highway 84 in Lubbock and its intersection with Interstate Highway 40 in Amarillo is designated as the Marshall Formby Memorial Highway.
(b) Requires the Texas Department of Transportation (TxDOT) to design and construct memorial markers indicating the highway number, the designation as the Marshall Formby Memorial Highway, and any other appropriate information.
(c) Requires TxDOT to erect a marker at each end of the highway and at the appropriate intermediate sites along the highway.
(d) Requires TXDOT to design, construct, and erect the markers only to the extent that money is available for this purpose from a grant or donation of private funds, notwithstanding Subsection (b) and (c).
(e) Requires funds collected by TxDOT under Section 225.021 for the purpose of implementing this section to be deposited to the credit of the state highway fund.
SECTION 2. Effective date: September 1, 2005.
