AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

C.S.S.B. 935 improves the method of evaluation for Texas Department of Housing and Community Affairs (department) applications for financial assistance for private activity bonds and low-income housing tax credits.  The bill also clarifies certain criteria to further the objectives of fair housing as required by state and federal law and creates variety in housing choices by preventing the concentration of low-income housing in any one neighborhood.    

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 2306.359(a), Government Code, to require the Department of Housing and Community Affairs (department), in evaluating an application for an issuance of private activity bonds, to score and rank the application using a point system based on criteria that are adopted by the department, including certain specified criteria.   

 

SECTION 2.  Amends Section 2306.6710(b), Government Code, to require the department, if an application satisfies the threshold criteria, to score and rank the application using a point system that follows certain procedures regarding certain specified criteria. 

 

SECTION 3.  Amends Section 2306.6725(a), Government Code, to require the department, in allocating low income housing tax credits, to score each application using a point system based on criteria adopted by the department that are consistent with the department's housing goals, including certain criteria addressing the ability of the proposed project. 

 

SECTION 4.  Makes application of this Act prospective. 

 

SECTION 5.  Effective date: September 1, 2005.
