AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

School resource officers are often asked by school districts to intervene when students with disabilities are experiencing a crisis at school where they pose a danger to themselves or others.  Officers are too often not trained in the specialized de-escalation and other behavior management techniques that have proven to be effective for students with disabilities. 

 

As proposed, S.B. 974 requires school resource officers to receive the same training in behavior management and the use of restraint that school districts are required to provide to other employees who intervene with students with disabilities.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 37.0021, Education Code, by amending Subsection (g) and adding Subsection (h), as follows:

 

(g)  Provides that this section and any rules or procedures adopted under this section does not apply to specific officials, except as provided by Subsection (h).

 

(h)  Requires a school resource officer, as defined by Section 1701.601 (Definition), Occupations Code, or a person employed under Section 37.081 (School District Peace Officers and Security Personnel) as a school district peace officer or as security personnel to receive any training required under Subsection (d)(2).

 

SECTION 2.  Makes application of this Act prospective to the 2005-2006 school year.

 

SECTION 3.  Effective date: upon passage or September 1, 2005.
