AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, the Texas Clean Fleet Program (TCFP), requiring emission standards for transit fleet vehicles, is codified in state statute, but has been superseded by federal standards.  The federal standards require cleaner fleet vehicles than specified in current state statute.  The repeal of the TCFP was included in H.B. 2 and the House Committee Report of S.B. 1592, 78th Legislature, Regular Session, 2003.  Failure to adopt either of these bills was due to other controversial measures that were included in the legislation, although the language repealing the TCFP for transit fleet vehicles was not considered controversial.

 

S.B. 1032 repeals TCFP from state statute.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Repealer: (1)  Subchapter F (Alternative Fuels Program), Chapter 382, Health and Safety Code; and

 

(2) the following subchapters of the Transportation Code:

 

(A) Subchapter G (Alternative Fuel Use Program), Chapter 451;

 

(B) Subchapter F (Alternative Fuel Use Program), Chapter 452; and

 

(C) Subchapter F (Alternative Fuel Use Program), Chapter 45.

 

SECTION 2.  Amends Section 113.287(e), Natural Resources Code, to make conforming changes.

 

SECTION 3.  Amends Section 2158.001, Government Code, to redefine "conventional gasoline."

 

SECTION 4.  Amends Section 1232.104(a), Government Code, to make conforming changes.

 

SECTION 5.  Repealer:  Sections 457.201(e) and 457.205 (Alternative Fuel Use Program), Transportation Code.

 

SECTION 6.  Effective date: September 1, 2005.
