AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, a political subdivision may not require a person who holds a driver's license or a commercial driver's license to obtain a license or permit for operating a tow truck unless the person performs nonconsent tows in the territory or subdivision. 

 

As proposed, S.B. 1062 allows a political subdivision to require a person who holds a driver's license or a commercial driver's license to obtain a license or permit for operating a tow truck if the person performs or proposes to perform nonconsent tows in the territory or subdivision.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 643.201(d), Transportation Code, as follows:

 

(d)  Authorizes a political subdivision to require, rather than prohibiting a political subdivision from requiring, a person who holds a driver's license or commercial driver's license to obtain a license or permit for operating a tow truck, if, rather than unless, the person performs or proposes to perform consent or nonconsent tows in the territory of the political subdivision.  Prohibits a fee charged for a license or permit from exceeding $15.

 

SECTION 2.  Effective date:  upon passage or September 1, 2005.
