AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Currently, a political subdivision may not require a person who holds a driver's license or a commercial driver's license to obtain a license or permit for operating a tow truck unless the person performs nonconsent tows in the territory or subdivision.
C.S.S.B. 1062 allows a political subdivision to require a person who holds a driver's license or a commercial driver's license to obtain a license or permit for operating a tow truck if the person performs tows in the territory or subdivision.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 643.201(d), Transportation Code, as follows:
(d) Authorizes a political subdivision, to protect the public safety, to require a person who holds a driver's license or commercial driver's license to obtain a license or permit for operating a tow truck if the person performs tows in the territory of the political subdivision, rather than prohibiting a political subdivision from requiring such a person to obtain a license or permit unless the person performs nonconsent tows.
SECTION 2. Effective date: upon passage or September 1, 2005.
