AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

C.S.S.B. 1100 amends Chapter 485, Government Code, by adding Section 485.008 to provide for the development of a Texas Music History Tour by the Music, Film, Television, and Multimedia Office (office), which is housed in the Office of the Governor.

 

C.S.S.B. 1100 provides minimum provisions for the program, including designation of places or organizations with historical significance to Texas' musical heritage, identifying devices for designees under the program, and development of maps and itineraries for tourism purposes.

 

C.S.S.B. 1100 also requires the office to develop eligibility criteria and rules for administration of the program.  The office is directed to enter into a memorandum of understanding with the Texas Commission on the Arts, the Texas Historical Commission, and the Texas Department of Transportation to aid implementation of Section 485.008.

 

C.S.S.B. 1100 permits the office to accept gifts, grants, and donations from any source which might be deemed to aid in implementing the program.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 485, Government Code, by adding Section 485.008, as follows:

 

Sec. 485.008.  TEXAS MUSIC HISTORY TOUR.  Requires the Music, Film, Television, and Multimedia Office (office) to develop a Texas Music History Tour program to promote and preserve Texas music history.  Sets forth minimum requirements for the program.  Requires the office to adopt certain criteria and procedures, and to enter into a memorandum of understanding with the Texas Commission on the Arts, the Texas Historical Commission, and the Texas Department of Transportation to implement this section.  Authorizes the office to solicit and accept gifts, grants, and other donations from any source to implement this section.  Provides that the office is not required to develop or implement the program under this section unless a grant or donation of private funds is made to the office to cover the cost of the development and implementation of the program.

 

SECTION 2.  Effective date:  September 1, 2005.
