BACKGROUND AND PURPOSE

 

Current law defining service areas for Austin Community College include all of Hays County, but a portion of two precincts of the San Marcos Consolidated Independent School District lie within Guadalupe County, a county that is wholly listed within the Alamo Community College District.  The change of community college service area designation for a portion of two voter precincts within Guadalupe County, from the current service area of the Alamo Community College District is needed if the whole of the San Marcos Consolidated Independent School District is to be allowed the opportunity to vote in an annexation election to join the Austin Community College taxing district.  Without the change, a portion of the residents of the school district would not be included in the community college taxing district and would not be eligible for in-district tuition.

 

As proposed, S.B. 1193 allows residents living within the entire San Marcos Consolidated Independent School District the opportunity to vote in an election to annex the district into the Austin Community College taxing district.  This bill also allows residents of the portion of these two precincts within the San Marcos Consolidated Independent School District to be included in the school district-wide election.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 130.162, Education Code, to provide that the service area of the Alamo Community College District includes territory in Guadalupe County, except the territory within the San Marcos Consolidated Independent School District.

 

SECTION 2.  Amends Section 130.166, Education Code, to provide that the service area of the Austin Community College District includes the area within the part of the San Marcos Consolidated Independent School District located in Guadalupe County.

 

SECTION 3.  Effective date.

 

EFFECTIVE DATE

 

This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
