AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, numerous Texas cities restrict or prohibit the construction of billboards.  However, municipal restrictions do not apply in rural and unincorporated areas.  Chapter 391.252(a), Transportation Code, bans new billboards on certain sections of highways. 

 

S.B. 1204 amends Chapter 391.251(a) to add State Highway 90 between the western city limits of the City of San Antonio and the eastern city limits of the City of Hondo to the list of roads along which the construction of billboards is prohibited.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 391.252(a), Transportation Code, to include a certain section of State Highway 90 among those sections of roadway along which a person may not erect an off-premise sign adjacent to and visible from.  Makes conforming changes.

 

SECTION 2.  Effective date: September 1, 2005.
