BACKGROUND AND PURPOSE

 

Currently, numerous Texas cities restrict or prohibit the construction of billboards.  However, municipal restrictions do not apply in rural unincorporated areas.  Current law bans new billboards on certain sections of highways.

 

As proposed, S.B. 1206 amends the Transportation Code to add a highway in Bandera County that is part of the state highway system to the list of roads on which it is forbidden to erect an off-premise sign adjacent to and visible from the road.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 391.252(a), Transportation Code, to prohibit a person from erecting an off-premise sign that is adjacent to and visible from a highway in Bandera County that is part of the state highway system.  Deletes existing text relating to the effective date of this chapter.

 

SECTION 2.  Effective date: September 1, 2005.
