AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The legal services division of the Texas Education Agency (TEA) has reviewed the statute regarding the legality of districts contracting with a county juvenile justice alternative education program to provide transportation for discretionary expelled students and have determined that such an arrangement is not authorized under Section 34.008, Education Code.

 

As proposed, S.B. 1248 allows school districts to contract with a juvenile board for the transportation of discretionary expelled students and for the school districts to receive funding from TEA for this service.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 34.008, Education Code, as follows:

 

Sec. 34.008.  New heading:  CONTRACT WITH TRANSIT AUTHORITY, COMMERCIAL TRANSPORTATION COMPANY OR JUVENILE BOARD.  Authorizes a board of county school trustees or school district board of trustees to contract with a juvenile board for all or any part of a district's public school transportation.

 

SECTION 2.  Effective date:  September 1, 2005.
