AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Brazoria County has experienced great population growth and is in need of a new court to handle the corresponding growth in cases pending in the county courts at law.  In 1987, all the county courts at law comprised an annual case disposition of 528 cases.  In 2004, that number has doubled to 1,127 cases.

 

As proposed, S.B. 1252 creates a fourth county court at law in Brazoria County.  

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 25.0221, Government Code, to add County Court at Law No. 4 and Probate Court of Brazoria County to the statutory county courts in Brazoria County.  Makes a nonsubstantive change.

 

SECTION 2.  (a) Creates the County Court at Law No. 4 and Probate Court of Brazoria County on January 1, 2007, notwithstanding Section 25.0221, Government Code, as amended by this Act.

 

(b) Requires the initial vacancy in the office of judge of the County Court at Law No. 4 and Probate Court of Brazoria County, notwithstanding Section 25.0009 (requiring appointment of a judge on creation of the office of the judge), Government Code, to be filled by election.  Provides that the office exists for purpose of the primary and general elections in 2006.  Provides that subsequent vacancies are filled as provided by Section 25.0009, Government Code. 

 

SECTION 3.  Effective date: September 1, 2005.
