AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
Current Texas law prohibits commingling used oil with solid waste except for that which is unavoidable and incidental to the mechanical shredding of motor vehicles, appliances, or other items of scrap. Problems have arisen from inconsistent treatment of the steps involved in the process of recycling motor vehicles, appliances, and other items of scrap with respect to the prohibition against commingling used oil with solid waste.
As proposed, S.B. 1299 provides an exception to the prohibition on commingling used oil with solid waste for the dismantling of motor vehicles, appliances, and other items of scrap in addition to the existing exception for mechanical shredding.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Sections 7.176(a) and (c), Water Code, to provide that a person commits an offense if the person knowingly mixes or commingles used oil with solid waste that is to be disposed of in landfills or directly disposes of used oil on land or in landfills, unless mixing or commingling of used oil with solid waste that is to be disposed of in landfills is incident to the unavoidable result of the dismantling or mechanical shredding of motor vehicles, appliances, or other items of scrap, used, or obsolete metals. Makes a conforming change.
SECTION 2. Makes application of Act prospective.
SECTION 3. Effective date: September 1, 2005.
