AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, auto titles are required to be transferred the same day as the sale of the vehicle.  This is a problem for the auto auction industry and can be a burdensome task.  After the sale of the motor vehicle at an auction the motor vehicle title is then turned over two to three days after the sale of said vehicle.      

 

As proposed, S.B. 1347 will extend the time auto auctions have to turn over the vehicle title to the new owner. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 501.071(a), Transportation Code, to prohibit a motor vehicle from being the subject of a subsequent sale unless certain procedures are followed, including that the seller transfers certificate of title to the buyer within five days after the sale at a motor vehicle auction.  

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
