AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Current law prohibits the legislature from reducing the appropriation to an institution of higher education in an amount relative to the amount of designated tuition an institution charges its students.  As proposed, S.B. 1484 repeals sections of the Education Code and restores the legislature's authority over the appropriations process.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 54.0513(c), Education Code, as follows:

 

(c)  Deletes existing text relating to a prohibition on institutional funds collected by an institution of higher education being accounted for in the general appropriations act.

 

SECTION 2.  Repealer:  Section 54.008(d) (Tuition Rate Set By a Governing Board), Education Code.

 

SECTION 3.  Effective date:  September 1, 2005.
