AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, residents of certain districts are fearful that a political subdivision will attempt to include the district within its boundaries without the consent of the district.  As proposed, S.B. 1498 prohibits said districts from being included in the boundaries of another political subdivision other than that of the county in which it is located unless the district consents.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 49, Water Code, by adding Section 49.466, as follows:

 

Sec. 49.466.  LAW ENFORCEMENT AND FIRE PROTECTION IN CERTAIN DISTRICTS.  (a)  Provides that this section only applies to certain districts.

 

(b)  Prohibits the area within a district described in Subsection (a) from being included within the boundaries of a political subdivision that provides law enforcement or fire protection services other than the counties in which it is located without the consent of the district.

 

SECTION 2.  Effective date:  upon passage or September 1, 2005.
