AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, residents of certain districts are fearful that a political subdivision will attempt to include the district within its boundaries without the consent of the district.  C.S.S.B. 1498 prohibits said districts from being included in the boundaries of another political subdivision other than that of the county in which it is located unless the district consents.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter H, Chapter 49, Water Code, by adding Section 49.237, as follows:

 

Sec. 49.237.  DISTRICT CONSENT REQUIREMENT.  (a)  Provides that this section only applies to certain districts.

 

(b)  Prohibits the area within a district described by Subsection (a) from being included without the consent of the district in the boundaries of a municipality that provides law enforcement or fire protection services.

 

SECTION 2.  Effective date:  upon passage or September 1, 2005.
