AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently the 22nd District Court has the jurisdiction to appoint bailiffs to the court.   As proposed, S.B. 1534 removes jurisdiction over appointing bailiffs from the 22nd District Court and returns jurisdiction to the Caldwell County Sheriff's Department.  This is to allow increased flexibility in scheduling and supervising bailiffs working in the courthouse. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 53.001(a), Government Code, to delete the judges of the 22nd District Court from the list of judges who are required to appoint a bailiff.

 

SECTION 2.  Amends Section 53.004(a), Government Code, to delete a bailiff of the 22nd  District Court from the list of bailiffs required to meet certain residency and age requirements to serve.

 

SECTION 3.  Amends Section 53.007(a), Government Code, to delete the 22nd District Court from the list of courts to which this section (relating to the deputizing of a bailiff) applies.

 

SECTION 4.  Amends Section 53.008, Government Code, to delete the bailiffs of the 22nd District Court from the list of bailiffs required to swear a certain oath.

 

SECTION 5.  Effective date: upon passage or September 1, 2005.
