AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 1579 allows billboards to be erected on U.S. Highway 281 between State Highway 186 and Interstate Highway 37, and allows the commissioners court of a county to prohibit the placement of billboards on certain roads.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 391.252(a) Transportation Code, to prohibit a person from erecting an off-premises sign that is adjacent to and visible from a public road or portion of a public road located outside the corporate limits or the extraterritorial jurisdiction of a municipality, if designated by order of the commissioners court of the county in which the road or portion of the road is located, after the date of written notice of the order to the Texas Department of Transportation.  Deletes existing text relating to the effective date of this subchapter and the prohibition of placement of signs at U.S. Highway 281 between State Highway 186 and Interstate Highway 37.  Makes nonsubstantive changes. 

 

SECTION 2.  Effective date: September 1, 2005.
