BACKGROUND AND PURPOSE

 

C.S.S.B. 1604 provides clarification of the Neches and Trinity Valleys Groundwater Conservation District.  The bill prohibits the district from levying any fee on a well used only for agriculture purposes within the district.  The bill also specifies that each director may be removed from office in the same manner as provided for the removal of a county officer.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 5, Chapter 1387, Acts of the 77th Legislature, Regular Session, 2001, by adding Subsection (g), to prohibit the Neches and Trinity Valleys Groundwater Conservation District (district) from assessing a fee of any type on a well if the well's production is used for domestic, agricultural, or wildlife purposes within the district.

 

SECTION 2.  Amends Section 6, Chapter 1387, Acts of the 77th Legislature, Regular Session, 2001, by adding Subsection (j) a director may be removed from office in the same manner as provided for the removal of a county officer and (k) the validity of the board is not affected by the fact that action was taken to remove a director.

 

SECTION 3.  Effective date: September 1, 2005.

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

Under Section 1, Subsection (g), the language "domestic, agricultural, or wildlife" is added.

Under Section 2, Sec. 6 "Board of Directors," Subsection (b) is removed and subsections (j) and (k) are added.
