AUTHOR'S/SPONSOR'S STATEMENT OF INTENT
The Lubbock Reese Redevelopment Authority (authority) is an entity that was created due to air force base closures under the federal Base Realignment and Closure process. The Reese authority board (board) has been having difficulty in achieving a quorum at their meetings.
S.B. 1751 reduces the number of directors from nine to seven and amends the criteria for appointment as a director. The board is also given the authority to appoint advisory boards.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 3501.051, Special District Local Laws Code, as follows:
Sec. 3501.051. COMPOSITION OF BOARD. (a) Creates this subsection from existing text. Provides that the board of directors of the Lubbock Reese Redevelopment Authority (board) is composed of five, rather than seven, directors appointed by the governing body of the City of Lubbock (governing body) from a list of persons recommended by the board under this section; and one director appointed by the commissioners court of Lubbock County (commissioners court) from a list of persons recommended by the board under this section.
(b) Requires the board, before the term of a director appointed under Subsection (a)(1) or (a)(2) expires, in consultation with the City of Lubbock or Lubbock County, as applicable, to recommend to the governing body or commissioners court a list of persons to serve on the succeeding board. Requires the governing body or the commissioners court, after reviewing the list of recommendations, to appoint the appropriate number of directors from the recommended persons or request that the board provide additional recommendations.
(c) Requires the governing body, the commissioners court, or the board, as appropriate, to make recommendations and appointments to the board so that places on the board are occupied by persons with experience in certain fields.
SECTION 2. Amends Subchapter C, Chapter 3501, Special District Local Laws Code, by adding Sections 3501.105 and 3501.106, as follows:
Sec. 3501.105. ADVISORY BOARDS. Authorizes the board to appoint advisory boards to assist the board in administering this chapter.
Sec. 3501.106. REVENUE BONDS. Authorizes the authority to issue for any authority purpose, bonds or other obligations payable from any source of authority revenue. Authorizes the authority to issue a bond or other obligation in the form of a bond, note, certificate of participation or other instrument evidencing a proportionate interest in payments to be made by the authority, or other type of obligation.
SECTION 3. (a) Defines "director."
(b) Makes application of this Act prospective to September 30, 2005.
(c) Sets forth that all board members' terms expire on September 30, 2005.
(d) Requires the governing body, the commissioners court, and the South Plains Association of Governments to appoint directors in accordance with this Act, not later than September 30, 2005. Sets forth terms of office for said directors.
SECTION 4. Effective date: upon passage or September 1, 2005.
