BACKGROUND AND PURPOSE

 

The Texas Constitution authorizes the creation of water control and improvement districts to supply and store water for use, operate sanitary wastewater systems, and provide irrigation, drainage, and water quality services.  On January 25, 2005, the Hays County Commissioners Court adopted a petition for the creation of South Buda Water Control and Improvement District No. 1 to cope with rapid growth in the Hays County area. 

 

SB 1792 authorizes creation of the district, subject to voter approval at a confirmation election.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SB 1792 authorizes creation of the South Buda Water Control and Improvement District No. 1. by voter approval at a confirmation election. The district is governed by Chapters 30, 49, and 51, Water Code and applicable provisions of Chapter 441, Transportation Code.  In addition, the bill authorizes the district to install and operate street lighting.

 

EFFECTIVE DATE

 

SB 1792 takes effect immediately if it receives a 2/3rds vote in both chambers, otherwise it takes effect Sept. 1, 2005.
