AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, Galveston County Municipal Utility District No. 52 (district) is in existence but has no mechanism to finance roads and major thoroughfares throughout the district. 

 

S.B. 1807 grants the district the powers it needs to finance roads, major thoroughfares and other navigation projects.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle F, Title 6, Special District Local Laws, by adding Chapter 8148, as follows:

 

CHAPTER 8148.  GALVESTON COUNTY MUNICIPAL UTILITY DISTRICT NO. 52

 

Sets forth standard language for the creation of the Galveston County Municipal Utility District No. 52 (district) in Galveston County.  Sets forth standards, procedures, requirements, and criteria for:

 

Creation and approval of the district (Sections 8148.001-8148.002);

 

Powers and duties of the district (Sections 8148.051-8148.055); and

 

General finance provisions and authority to issue bonds and obligations for the district (Section 8148.101).

 

Limits the exercise of eminent domain to the district for the acquisition of an easement to provide services to the district (Section 8148.055).

 

SECTION 2.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished. 

 

SECTION 3.  Effective date: upon passage or September 1, 2005.
