AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

As proposed, S.B. 1869 updates statutory references to Harris County protective services entities, following the merger of the Harris County Adult Guardianship Program and the Harris County Children's Protective Services. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Sections 152.1073(a)(1) and (3), Human Resources Code, to redefine "board" and "institution."

 

SECTION 2.  Amends Sections 152.1073(g) and (h), Human Resources Code, as follows:

 

(g)  Authorizes the Department of Aging and Disability Services, rather than the Department of Human Services, and Department of Family and Protective Services, in the addition to the authority granted to the Harris County Board of Protective Services for Children and Adults (board) by the commissioners court, to receive, refuse, accept, disburse, account for, and use certain funds and create a certain guardianship program. 

 

(h)  Requires the board to designate the director or an assistant to apply for letters of guardianship or to sign court exhibits if necessary to receive funds under Subsection (g)(7).  Makes a conforming change. 

 

SECTION 3.  Effective date: upon passage or September 1, 2005.
