AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, Hidalgo County has five county courts at law.  Due to rapid growth in Hidalgo County, these courts are overloaded and an additional county court at law is needed.

 

As proposed, S.B. 1875 addresses this current law by creating an additional court, namely County Court at Law No. 6 of Hidalgo County.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 25.1101(a), Government Code, to include County Court at Law No. 6 of Hidalgo County as one of Hidalgo County's statutory county courts.

 

SECTION 2.  Amends Section 25.1102, Government Code, by adding Subsection (b), to require the County Court at Law No. 6 of Hidalgo County to give preference to family law cases and proceedings, other than cases and proceedings in which family violence is alleged.

 

SECTION 3.  Creates the County Court at Law No. 6 of Hidalgo County on the effective date of this Act.

 

SECTION 4.  Effective date: September 1, 2005.
