A BILL TO BE ENTITLED
AN ACT
relating to the amount of alcohol that may be served in a drink by
the holder of an alcoholic beverage permit or license; providing
criminal penalties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 101, Alcoholic Beverage
Code, is amended by adding Section 101.76 to read as follows:
Sec. 101.76. LIMITATION ON ALCOHOL CONTENT OF DRINKS
SERVED. (a) The holder of a permit or license that authorizes the
holder to serve alcoholic beverages for on-premises consumption may
not serve a drink that contains more than one-half ounce of absolute
alcohol or the equivalent.
(b) A person who violates this section commits an offense.
(c) An offense under this section is a Class A misdemeanor.
SECTION 2. This Act takes effect September 1, 2005.
