A BILL TO BE ENTITLED
AN ACT
relating to the legislature's obligation to provide state funding for the public education system. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 42.001, Education Code, is amended by adding Subsections (c) and (d) to read as follows: (c) The legislature shall provide state funding in an amount that constitutes at least 55 percent of the cost of maintaining and operating the public school system. (d) The legislature may not recapture more than 35 percent of a school district's revenue from ad valorem taxes for the maintenance of public schools in the district. In this subsection, "recapture" means a system under which a school district is required to use a portion of the district's local ad valorem tax revenue for the benefit of public schools in this state other than those in the district, including: (1) the remittance of revenue to a state officer or agency for redistribution to other school districts; (2) the remittance of revenue to another school district for use by that district; and (3) the use of revenue to administer and operate a shared services program between the school district raising the revenue and one or more other school districts. SECTION 2. This Act takes effect September 1, 2006.
