A BILL TO BE ENTITLED
AN ACT
relating to outside employment by school district superintendents. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 11.201 of the Education Code is amended by adding Subsection (e) to read as follows: (e) A superintendent may not receive any financial benefit for personal services performed by the superintendent for any business entity that conducts or solicits business with the school district. Any financial benefit received by the superintendent for performing personal services for an entity that does not conduct or solicit business with the school district must be approved by the board of trustees on a case by case basis in an open meeting. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
