A BILL TO BE ENTITLED
AN ACT
relating to the authority of a municipality to regulate certain
property with historical, cultural, or architectural importance.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 211.003(b), Local Government Code, is
amended to read as follows:
(b) In the case of designated places and areas of
historical, cultural, or architectural importance and
significance, the governing body of a municipality may regulate the
construction, reconstruction, alteration, or razing of buildings
and other structures. A regulation adopted under this subsection
does not apply to property exempt from taxation under Section
11.20, Tax Code.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
