A BILL TO BE ENTITLED

AN ACT

relating to the authority of certain counties to apply a county fire 
code to certain buildings.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 233.062(a), Local Government Code, is 
amended to read as follows:
	(a)  The fire code applies only to the following buildings 
constructed in an unincorporated area of the county:
		(1)  a commercial establishment; [and]                       
		(2)  a public building; and                                            
		(3)  a multifamily residential dwelling consisting of 
four or more units.
	SECTION 2.  (a) This Act applies only to a multifamily 
residential dwelling on which construction begins on or after the 
date a fire code applicable to multifamily residential dwellings is 
adopted under this Act.
	(b)  For purposes of this section, construction begins on the 
date that ground is broken for a multifamily residential dwelling, 
or if no ground is broken, on the date that the first materials are 
added to the original property.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
