A BILL TO BE ENTITLED

AN ACT

relating to the authority of a county to charge a fee for approving 
and directing the laying of certain pipes or pipelines.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 111.020, Natural Resources Code, is 
amended by adding Subsection (e) to read as follows:
	(e) The commissioners court of a county may charge a common 
carrier a fee for approving and directing the laying of a pipe or 
pipeline under Subsection (b)(4) in the amount of:
		(1)  $300 if the pipe or pipeline has a diameter of less 
than six inches; or
		(2)  $800 if the pipe or pipeline has a diameter of six 
inches or more.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
