A BILL TO BE ENTITLED
AN ACT
relating to an offense of possession of certain devices affecting operation of a traffic-control signal. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter K, Chapter 547, Transportation Code, is amended by adding Section 547.615 to read as follows: Sec. 547.615. MOBILE INFRARED TRANSMITTER PROHIBITED. (a) In this section, "mobile infrared transmitter" means a device that emits an infrared beam with the capability of changing a traffic-control signal out of sequence. (b) A person may not possess a mobile infrared transmitter. (c) This section does not apply to possession of a mobile infrared transmitter by a person in connection with official operation of: (1) an authorized emergency vehicle; or (2) a transit vehicle operated by an authority under Chapter 451 or 452 or a transit department under Chapter 453. SECTION 2. This Act takes effect September 1, 2005.
