A BILL TO BE ENTITLED
AN ACT
relating to an exemption from the fee for a birth or death record requested by a law enforcement agency, a child fatality review team, or the child fatality review team committee. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 191.0046, Health and Safety Code, is amended by adding Subsections (d) and (e) to read as follows: (d) The state registrar or a local registrar on request shall issue without fee: (1) a certified copy of a birth or death record to a law enforcement agency of this state or of a political subdivision of this state; or (2) a copy of a birth or death record to a child fatality review team or the child fatality review team committee established under Subchapter F, Chapter 264, Family Code. (e) The state registrar or a local registrar may issue a copy of a birth or death record that is not certified to a child fatality review team or the child fatality review team committee. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
