A BILL TO BE ENTITLED

AN ACT

relating to the applicability of a definition of "individual" to 
certain offenses under the Texas Controlled Substances Act.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 481.122, Health and Safety Code, is 
amended by adding Subsection (d-1) to read as follows:
	(d-1)  The definition of "individual" under Section 1.07, 
Penal Code, does not apply to this section.
	SECTION 2.  The amendment by this Act to Section 481.122, 
Health and Safety Code, is intended to clarify rather than change 
existing law.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
