A BILL TO BE ENTITLED
AN ACT
relating to the online availability of certain state publications.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter G, Chapter 441, Government Code, is
amended by adding Section 441.1035 to read as follows:
Sec. 441.1035. MAILED STATE PUBLICATIONS; NOTICE; ONLINE
AVAILABILITY. (a) A state agency that mails a state publication
shall make the publication accessible in an electronic format from
the agency's Internet website. If the agency does not have a
website, the agency shall deposit the electronic source file for
the publication in the manner prescribed by commission rules.
(b) When mailing a state publication, a state agency that
makes the publication accessible on its Internet website must
inform each recipient of the publication that the recipient may,
instead of receiving a mailed copy, access the publication at the
agency's Internet website.
(c) If a recipient prefers to access a publication at the
state agency's Internet website and notifies the agency of that
preference, the agency shall:
(1) remove the recipient from the mailing list for
that publication; and
(2) notify the recipient electronically each time the
publication becomes available at the agency's Internet website and
provide an electronic link to the publication.
SECTION 2. This Act takes effect September 1, 2005.
