A BILL TO BE ENTITLED

AN ACT

relating to the regulation of barbers and cosmetologists at mobile 
locations.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 1601.302(b), Occupations Code, is 
amended to read as follows:
	(b)  The application must provide:                                             
		(1)  the permanent address of the barbershop, unless 
the barbershop is at a mobile location;
		(2)  the legal description of the premises to be 
licensed, unless the barbershop is at a mobile location; and
		(3)  other information required by the board.                                 
	SECTION 2.  Subchapter G, Chapter 1601, Occupations Code, is 
amended by adding Section 1601.306 to read as follows:
	Sec. 1601.306.  MOBILE LOCATION ALLOWED.  A barbershop may 
be operated at a mobile location.
	SECTION 3.  Subchapter G, Chapter 1602, Occupations Code, is 
amended by adding Section 1602.307 to read as follows:
	Sec. 1602.307.  MOBILE LOCATION ALLOWED.  A facility at 
which cosmetology is practiced may be a mobile location.
	SECTION 4.   This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
