A BILL TO BE ENTITLED
AN ACT
relating to the proximity of a school bus stop to the residence of a
sex offender or sexually violent predator.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 34, Education Code, is amended by adding
Section 34.012 to read as follows:
Sec. 34.012. LOCATION OF BUS STOP. (a) A school district
that transports students in connection with school activities
shall, to the extent practicable, locate each bus stop or other
place designated as a place of entry to or exit from a district
transit vehicle at least 1,000 feet from the residence of a person
who is:
(1) required to register as a sex offender under
Chapter 62, Code of Criminal Procedure, because of conduct
involving a victim younger than 17 years of age; or
(2) civilly committed as a sexually violent predator
under Chapter 841, Health and Safety Code, and subject to
outpatient treatment and supervision under that chapter.
(b) The distance described by Subsection (a) must be
measured in a straight line from the nearest property line of the
residence to the bus stop or other designated place.
SECTION 2. This Act applies beginning with the 2005-2006
school year.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
