A BILL TO BE ENTITLED
AN ACT
relating to the penalty for failure to yield the right-of-way. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 545.153, Transportation Code, is amended by adding Subsection (e) to read as follows: (e) If it is shown on the trial of an offense under this section that as a result of the commission of the offense: (1) a collision causing property damage occurred, the offense is a misdemeanor punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both the fine and the confinement; or (2) a collision causing serious bodily injury or death occurred, the offense is a misdemeanor punishable by a fine of not more than $4,000 and confinement in jail for not less than 30 days and not more than one year. Section 2. Section 11, Article 42.12, Code of Criminal Procedure, is amended by adding Subsection (n) to read as follows: (n) A judge granting community supervision to a defendant convicted of an offense under Section 545.153, Transportation Code, shall require as a condition of community supervision that the defendant submit to not less than 30 days of confinement in jail if the offense resulted in serious bodily injury or death. SECTION 3. (a) The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. For purposes of this section, an offense is committed before the effective date of this Act if any element of the offense occurs before that date. (b) An offense committed before the effective date of this Act is covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. SECTION 4. This Act takes effect September 1, 2005.
