A BILL TO BE ENTITLED
AN ACT
relating to certain requirements for the prescription of
medications by a veterinarian.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter H, Chapter 801, Occupations Code, is
amended by adding Section 801.362 to read as follows:
Sec. 801.362. PRESCRIPTIONS. (a) A veterinarian who
determines that an animal under the veterinarian's care requires a
prescription medication may not refuse to provide the owner of the
animal with a copy of the prescription.
(b) The veterinarian may not require the owner of the animal
to purchase from the veterinarian a prescription medication under a
prescription written by the veterinarian.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2005.
