A BILL TO BE ENTITLED
AN ACT
relating to the requirement of overhead roll bars on certain
all-terrain vehicles.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. SHORT TITLE. This Act may be cited as the Tina
Marie Miskell Cooper Act.
SECTION 2. Subchapter A, Chapter 663, Transportation Code,
is amended by adding Section 663.003 to read as follows:
Sec. 663.003. OVERHEAD ROLL BARS REQUIRED AFTER JANUARY 1,
2006. (a) A person may not offer or distribute for sale or sell in
this state a new all-terrain vehicle manufactured or assembled on
or after January 1, 2006, unless the vehicle is equipped with an
overhead roll bar that complies with standards and specifications
prescribed by rules adopted under this section.
(b) The Department of Public Safety shall adopt rules to
implement and enforce this section, including rules that prescribe
standards and specifications for overhead roll bars on new
all-terrain vehicles that are covered by Subsection (a).
SECTION 3. (a) This Act takes effect September 1, 2005.
(b) The Texas Department of Public Safety shall adopt rules
to implement Section 663.003, Transportation Code, as added by this
Act, not later than October 31, 2005.
